Ross O. Kloeber IV
Ross Kloeber is an associate in the firm’s Litigation Group. He has experience representing both defendants and plaintiffs in a variety of complex civil litigation in state and federal courts at both the trial and appellate levels, with a particular focus on securities, shareholder, and corporate governance issues.
Ross focuses his practice on complex civil litigation in state and federal courts, at both the trial and appellate levels. He has particular experience with securities, shareholder, and corporate governance disputes, including those arising out of mergers and acquisitions and other high-value transactions. Ross has represented clients in a range of industries including the financial services and life sciences industries. He has broad experience litigating complex commercial disputes, including at trial. In addition, he advises clients facing regulatory and enforcement scrutiny, including investigations by the SEC, DOJ, FINRA, state financial services regulators and other self-regulatory organizations (SROs).
Ross earned his J.D. from the University of Notre Dame, where he served as a senior editor on the Notre Dame Journal for Law, Ethics, and Public Policy and as vice president of the Moot Court Board. He received his B.A. in anthropology from the University of Rochester, where he was also a four-year member of the football team.
- Successfully obtained dismissal under Rule 12(b)(6) of a putative class action lawsuit alleging various consumer data privacy violations against a global pharmacy chain.
- Represented a pharmaceutical drug manufacturer in federal qui tam litigation under the False Claims Act.
- Represented a major securities clearing house in a civil action involving allegations of insider trading before reaching a favorable settlement.
- Represented a private equity firm in opposing an emergency motion for a receivership related to an action for foreclosure on a large commercial real estate property in Illinois state court before reaching a favorable settlement.
- Represented a hedge fund in a case involving a variety of breach of contract and unfair business practices claims in federal court.
- Represented a Fortune 100 company in multiple state lawsuits alleging violations of various state false claims acts related to the issuance of municipal securities.
- Successfully obtained court-ordered inspection of corporate books and records on behalf of a minority shareholder in connection with a disputed going private transaction.
