Richard S. Wilson

As a member of the Firm’s Chambers-ranked Construction Law Group, Richard represents contractors, owners, and developers in disputes arising from complex construction projects. Richard has extensive experience handling claims related to all aspects of the design and construction of commercial projects, including claims arising out of project delay and acceleration, losses of productivity and efficiency, design errors and omissions, construction and product defects, cumulative impacts, differing site conditions, payment disputes, and complex mechanics liens. Richard’s experience extends to both litigation and arbitration, and his practice is national in scope.

Representative Litigation and Arbitration Engagements

• Represented design-builder in Washington state court litigation involving prosecution and defense of over $160 million in claims based upon project delay, labor inefficiencies, design errors and omissions, and payment disputes, arising from a $1 billion expansion of a major international airport.
• Defended large, nationally recognized general contractor against over $20 million in claims brought by owner of a public college based on alleged defects involving building elevators and underground storm water management system, obtaining a favorable arbitration award that resulted in the client ultimately paying nothing on the owner’s claims.
• Represented joint venture comprised of large general contractors in action involving differing site conditions and resulting payment disputes arising from the performance of underground tunnelling work at a major international airport.
• Defeated TRO brought against large general contractor client by would-be subcontractor arising out of bid protest on federally funded airport project.
• Represented a photovoltaic cable supplier in federal court litigation involving claims for manufacturing defects against the cable manufacturer.
• Represented developer in Florida state court trial involving construction defects and mechanics liens arising from curtainwall and building envelope installation on a luxury condominium project.
• Represented large, nationally recognized general contractor on a hospital project in Indiana, in connection with claims asserted by low-voltage and fire alarm subcontractor involving delegated design, disputed change orders, project delays, and loss of efficiency.
• Represented multinational general contractor in pursuing substantial claims against SDI carrier for project changes, inefficiencies, and delay caused by non-performing subcontractor, and defended client against claims by other trades based upon the non-performing subcontractor’s conduct.
• Represented multinational hotel operator in connection with claims asserted by a building owner concerning HVAC issues and disputed building upgrades.
• Represented owner of a franchise restaurant in Michigan state court litigation involving claims for construction defects and payment disputes.
• Represented developer in Illinois state court action arising out of claims for construction defects brought by a condominium association.
