Natalie R. Holden
Natalie Holden is a partner in the firm’s Litigation and Energy Groups. She is a creative problem solver, litigator, and advisor who represents clients in complex commercial and governmental disputes in a wide variety of industries that include energy, real estate, manufacturing, construction, technology, health care, and financial services.
Natalie sees the big picture and understands that litigation is often something that businesses want to avoid. Her primary goal in any dispute is to understand a client’s business objectives and effectively work toward a resolution that protects those interests. She is an effective negotiator and has a track record of quick resolutions of disputes ranging from early dismissals, quick and favorable settlements, and negotiating desired actions from government officials. She can quickly understand the strengths of a case and dives into the facts and law early on to reach a positive outcome for the client, with the goal of avoiding expensive and protracted legal fees.
Natalie is effective at applying pressure early on based on her extensive experience in complex commercial and governmental litigation proceedings and willingness to litigate fully when necessary. She is versed in all aspects of litigation and arbitration, including discovery, motion practice, pleadings, appellate briefs, and preparing for and participating in contested evidentiary hearings. She has drafted and argued numerous successful dispositive motions in both federal and state court. Natalie has worked on several trial teams where she prepared expert and non-expert witnesses, opening and closing statements, cross-examinations of key witnesses, and engaged in other pre-trial strategy. She successfully first-chaired a contested evidentiary hearing where she conducted a direct examination of the primary witness and delivered a closing argument.
She is also experienced in a variety of governmental disputes, including negotiating permitting approvals for solar projects, FOIA litigation, and successful challenges to state and local government statutes, ordinances, and regulations on constitutional grounds.
Natalie also advises clients on legal risks of policies and business practices in a forward-thinking manner to help clients successfully get ahead of potential legal hurdles and pitfalls and protect their business.
- Won a motion to dismiss on all counts of a multistate and multiclaim consumer class action complaint alleging breach of warranty, fraud, unjust enrichment, and consumer fraud claims.
- First-chaired an asylum evidentiary hearing for a pro bono client, preparing the client for hearing, conducting a direct exam, and delivering a closing argument, resulting in a grant of asylum for the client.
- Defending an automobile manufacturer and distributor in several putative class action lawsuits alleging breach of warranty, fraud, unjust enrichment, and unfair and deceptive trade practices in connection with the manufacturing, design, advertising, marketing, and/or sale of the vehicles.
- Prepared a case for trial, handling all aspects of litigation that included evaluating claims and legal issues, preparing for witness examinations and opening statement at trial, and drafting and arguing pre-trial motions. Ultimately secured a favorable outcome for the client on the eve of trial.
- Second-chaired an arbitration resulting in a favorable verdict for a vehicle financing company.
- Prepared appellate briefs on various contractual and patent-related issues before the U.S. Court of Appeals for the Federal Circuit.
- Successfully obtained a preliminary injunction in federal court, challenging a state regulation with widespread commercial consequences based on First Amendment free speech grounds.
- Advised clients on potential legal risks related to a number of internal and external business practices, contracts, and policies.
- Prepared and argued motion to strike class allegations in a breach of fiduciary duty class action lawsuit.
- Prepared a motion for preliminary injunction and third-chaired an oral argument in federal court, challenging state regulation based on dormant commerce clause grounds.
- Prepared and won a motion for summary judgment under the Freedom of Information Act, challenging the federal government’s withholding of certain documents.
