Jack T. LeBris Erffmeyer is a partner in the Firm’s Chambers-ranked Energy Law Group. Jack works with a diverse array of clients in the solar energy and energy storage industries, as well as energy trade associations, including representation in formal disputes and docketed litigation proceedings before the Illinois Commerce Commission (ICC), providing regulatory counseling and due diligence for renewable energy incentives programs administered by the Illinois Power Agency, and offering guidance on compliance with State labor statutes and local ordinances pertaining to renewable energy development.

Jack’s prior experience in private practice ranged from high-value Federal Energy Regulatory Commission (FERC) administrative litigation proceedings on behalf of shippers on crude oil and refined petroleum product pipelines to regulatory advising and due diligence for national developers of renewable energy focusing on projects in Illinois.

Prior to entering private practice, Jack worked as an Assistant Attorney General for the Public Utilities Bureau in the Office of the Illinois Attorney General, where he was responsible for the prosecution and management of all aspects of administrative litigation before the ICC on electricity and natural gas cases and before FERC on interstate wholesale electricity market cases. His experience before the ICC includes casework related to formula rate update cases, traditional rate cases, and rider reconciliations, implicating issues such as prudence of capital expenditures, cost-allocation, novel rate designs, accumulated and excess deferred income tax regulatory accounting, statutory infrastructure upgrade programs, bad debt expense, return on equity, and ratemaking implications of the 2017 federal income tax law change. Prior to joining the firm, Jack worked as an energy associate in the Washington, D.C. office of Greenberg Traurig LLP.

  • Managed an 18-month discovery process in a complaint before FERC against a major refined petroleum product pipeline that led to the parties entering into a settlement.
  • Litigated as part of a three-attorney team a major RTO/ISO capacity market case before FERC on behalf of the People of the State of Illinois from initial protest of tariff filings, to initial and reply briefs and testimonies in a new contested proceeding, and two requests for rehearing.
  • Coordinated with aligned parties and lead drafting of a protest to FERC for a group of consumer advocates in an RTO/ISO tariff filing proceeding seeking to dramatically modify the capacity market of a specific capacity zone within the grid operator’s territory.
