L. Brandon Liss

Brandon Liss is a partner in the Firm’s Litigation and Employment Law Groups. Brandon, a former federal prosecutor, focuses his practice on complex commercial litigation and employment litigation involving, among other things, deal disputes and other breaches of contract; restrictive covenants; various business torts; shareholder derivative and fiduciary duty litigation; internal investigations; allegations of discrimination, harassment, and retaliation; and wage and hour disputes. Brandon also has experience representing clients in litigation-related bankruptcy proceedings and the administration of receivership estates.

In addition to his litigation practice, Brandon also serves as a trusted advisor and provides business-oriented and preventative counseling to clients in a variety of commercial and employment-related matters.

Brandon previously served as an Assistant United States Attorney in the Southern District of California (San Diego) where he prosecuted an array of cases involving, among other things, narcotics trafficking, human smuggling, and immigration offenses. Brandon briefed and argued numerous matters before the magistrate and district courts, regularly handled various court appearances, including evidentiary and sentencing hearings, negotiated plea agreements, and presented cases in Grand Jury proceedings. Brandon also collaborated with various law enforcement agencies, including serving on prosecution teams for investigations involving digital opioid distribution and public corruption. In addition, Brandon successfully represented the United States before the Ninth Circuit, briefing and arguing an appeal from a sentence imposed upon revocation of supervised release in United States v. Donato Aguirre-Garcia, Case No. 23-337.

Prior to joining Fox Swibel, Brandon was an associate at McDermott Will & Emery LLP and clerked for two federal judges—Judge Charles R. Norgle, Sr. and Magistrate Judge M. David Weisman—both of the Northern District of Illinois.

Brandon earned his B.A. with honors from Northwestern University, summa cum laude, where he was inducted into Phi Beta Kappa. He received his J.D. from The University of Chicago Law School. While in law school, Brandon worked in the Federal Criminal Justice Clinic where he assisted in defending indigent clients charged with federal crimes.

Outside of his practice, Brandon has served as an adjunct professor of law at Loyola University Chicago School of Law where he taught a second-year law course focused on developing legal research skills, written advocacy, oral presentation, appellate advocacy, and professionalism.

  • Obtained summary judgment, complete dismissal, and affirmance by First District Appellate Court for private detective agency against alleged privacy torts.
  • Briefed and argued, and prevailed in, Ninth Circuit appeal of sentence imposed upon revocation of supervised release in United States v. Donato Aguirre-Garcia, Case No. 23-337.
  • First-chaired, and prevailed in, evidentiary hearing establishing identity of person indicted in connection with conspiracy to smuggle firearms from United States to transnational organized crime syndicate in Mexico.
  • Presented cases before Grand Jury, including witness preparation and examination, and secured indictments related to narcotics trafficking, human smuggling, and immigration offenses.
  • Representation of Fortune 500 company in internal investigation and shareholder derivative action alleging breach of fiduciary duties.
  • Representation of Fortune 500 company in products liability action alleging that wireless telephone use caused brain tumors.
  • Obtained summary judgment and complete dismissal for large label printing company against employee’s allegations of race discrimination.
  • Obtained partial summary judgment leading to favorable settlement on behalf of large integrated benefits, payroll, and cloud solutions provider in action against former top executive involving alleged breaches of equity and severance agreements, trade secrets claims, and allegations of age discrimination, sex discrimination, and retaliation.
  • Obtained favorable settlement after partial summary judgment on behalf large manufacturer where EEOC and employee alleged age and disability discrimination.
  • Defeated Attorney General’s motion for summary judgment in Section 1983 case resulting in favorable settlement for pro bono client.
  • Defeated motion for temporary restraining order on behalf of capital solutions provider in connection with alleged $7.5 million breach of contract.
  • Obtained pre-certification voluntary dismissal of class action complaint asserting consumer fraud and deceptive business practices against large restaurant group.
  • Obtained complete dismissal of claims for breach of warranty on behalf of global provider of automotive risk management solutions.
  • Obtained complete dismissal of claims for breach of warranty against global provider of automotive risk management solutions, automobile dealership, and insurance and warranty solutions company.
  • Obtained dismissal of employee’s tort claim against supervisor.
  • Representation of court-appointed receiver in SEC enforcement action arising out of Ponzi Scheme.
  • Representation of large insurance company in Seventh Circuit bankruptcy appeal.
  • Representation of companies and former employees in actions related to the enforcement of post-employment restrictive covenants with claims involving non-competition, non- solicitation, confidentiality and trade secrets provisions.
  • Representation and counseling of startup companies in commercial and employment-related matters.
  • Argued numerous motions in state and federal court.

In 2023, Brandon was recognized as an Illinois Rising Star, a list published by Super Lawyers. Rising Stars uses a patented multiphase selection process which includes peer nominations and evaluations combined with third-party research. Each candidate is evaluated on 12 indicators of peer recognition and professional achievement. Attorneys who have been selected to the list of Illinois Rising Stars make up 2.5 percent of lawyers in Illinois who have been in practice for less than ten years. These selections are made on an annual basis.
