Erik R. Nelson

Erik Nelson is a partner in the Firm’s Chambers-ranked Construction Law Group. Erik concentrates his practice on complex construction disputes. He has experience representing owners, contractors, trade contractors and architects in mediation, arbitration and litigation involving delay and acceleration, changes, design errors, mechanics liens, construction defects and insurance coverage. In addition to dispute resolution work, Erik has experience drafting and negotiating contracts and subcontracts.

  • Represented general contractor in arbitration against subcontractor obtaining award finding subcontractor responsible for damage to an adjacent property and recovering general contractor’s costs for loss of efficiency, delay and acceleration to complete the project after suspension.
  • Represented a multiple prime contractor in arbitration against owner of a hospital project obtaining award finding owner’s construction manager responsible for out-of-sequence work and recovering prime contractor’s loss of efficiency, delay and acceleration damages.
  • Represented general contractor in arbitration against glazing subcontractor on historical renovation of a high-rise condominium building recovering general contractor’s costs to complete terminated subcontractor’s defect work and defeating subcontractor’s claim for damages.
  • Represented concrete subcontractor on a fifty-two story residential condominium building winning summary judgment on defective work claim filed by the association and then, after the underlying suit, recovered in separate lawsuit all defense costs from owner-controlled insurance program insurer.
  • Represented construction project owner against property damage claim of adjacent owner obtaining settlement after mediation primarily utilizing indemnifying general contractor’s disputed “contractual liability” coverage feature of commercial general liability insurance and subcontractor’s insurance.
  • Represented electrical contractor on claims of delay, disruption and changes on in-progress unit price urban underground telecommunications infrastructure project obtaining settlement through mediation.
  • Represented prime contractor on claim against owner for damages from suspension and delays on a hotel project obtaining settlement on the eve of arbitration hearing.
  • Represented foundation contractor in mechanics lien foreclosure lawsuit defeating mortgagee’s motion for summary determination of priority resulting in purchase of foundation contractor’s rights against developer on abandoned project for construction of tallest building in Western Hemisphere.
