Only days after a Fifth Circuit panel lifted the injunction on the Corporate Transparency Act (CTA), another Fifth Circuit panel has reinstated the injunction. Once again, the federal government is prohibited from enforcing the CTA, and filing of beneficial ownership information is now voluntary.
The Fifth Circuit scheduled arguments for March 25, 2025 on the merits of the government’s appeal. We still advise that companies continue to seek guidance from counsel regarding the applicability of the CTA and to gather required beneficial ownership information in order to facilitate timely compliance.
